These Early Access Terms apply to your participation in the eBECAS Early Access Program and your access to or use of any Early Access Service made available by Equator IT. By participating in the Early Access Program or using an Early Access Service, you agree to these Early Access Terms.

Eligibility and Participation Early Access Services Feedback Intellectual Property Modification and Termination Warranty Confidential Information Compliance with Laws

1. Eligibility and Participation

These Early Access Terms apply when you access or use an Early Access Service. They supplement and form part of the eBECAS Customer Terms of Service, Product Specific Terms and Acceptable Use Policy (together, the Agreement).

If there is an inconsistency between these Early Access Terms and the Agreement, these Early Access Terms prevail only in relation to the Early Access Service. The Customer Terms of Service prevail in all other respects.

Your access to Early Access Services ends if you cease to be an eBECAS customer, or if Equator IT suspends, discontinues or terminates the relevant Early Access Service.

2. Early Access Services

Early Access Service means a service, or a feature of a service, that is designated or made available as alpha, beta, experimental, pilot, limited release, in development, developer preview, early access, non-production or evaluation, before general availability.

By accepting these Early Access Terms or using an Early Access Service, you acknowledge that Early Access Services are provided on an “as is” and “as available” basis. They may contain bugs, errors and other problems. To the maximum extent permitted by law, you assume the risks and costs associated with your use of Early Access Services. Equator IT is not obliged to provide maintenance, technical support or other support for Early Access Services.

3. Feedback

Early Access Services are made available for evaluation and feedback purposes. You may provide Equator IT with suggestions, comments, ideas or other feedback about an Early Access Service (Feedback).

You grant Equator IT a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, modify, adapt and incorporate Feedback into its products and services without compensation or obligation to you. Equator IT will not publicly identify you as the source of Feedback without your permission.

Equator IT may collect and use technical, operational and usage information generated through use of Early Access Services in accordance with the Agreement and Privacy Policy. This does not permit Equator IT to use identifiable Customer Data to train, fine-tune, test, evaluate or improve an artificial intelligence or machine-learning model, or otherwise beyond what the Agreement permits.

4. Intellectual Property

Except to the extent permitted by law, you agree not to modify, distribute, prepare derivative works of, reverse engineer, reverse assemble, disassemble, decompile or otherwise attempt to decipher any code in connection with the Early Access Services and/or any other aspect of eBECAS technology.

5. Modification and Termination

Equator IT may change, suspend, discontinue or limit access to an Early Access Service or the Early Access Program at any time, including without prior notice, where reasonably necessary for product development, security, operational, legal or commercial reasons.

Any amendment to these Early Access Terms will be made in accordance with the provisions of the Customer Terms of Service governing changes to the Agreement.

These Early Access Terms end in relation to an Early Access Service when that Early Access Service is made generally available, discontinued or access to it is terminated. The remainder of the Agreement continues to apply.

Equator IT may terminate access to an Early Access Service where you breach these Early Access Terms or the Agreement, including the confidentiality obligations applying to Early Access Services.

6. Warranty

To the maximum extent permitted by law, Equator IT makes no warranties, express or implied, guarantees or conditions with respect to Early Access Services or your use of them.

7. Confidential Information

You acknowledge and agree that: (i) the Early Access Program and Early Access Services are Confidential Information under the Customer Terms of Service; (ii) you must keep confidential all non-public eBECAS information and details disclosed, accessed through or embedded in the Early Access Program, including Early Access Services; (iii) unauthorised disclosure may adversely affect Equator IT’s competitive position and intellectual property interests; and (iv) you must not disclose details concerning Early Access Services to anyone other than authorised users within your eBECAS subscription, unless Equator IT agrees otherwise in writing.

8. Compliance with Laws

You agree to comply with all applicable laws, rules and regulations, including applicable import and export laws and regulations, in connection with your participation in, access to and use of the Early Access Program and Early Access Services.
